Spurring Spirit of Syari’ah Insurance

Indonesia is most dominantly  Moslem embraced country. It has capacity in terms of population as well as market for Islamic economic products. The question arises as how far the understanding of Indonesian Moslem to the Islamic economy? The market of Syari’ah Insurance is still widely open to be penetrated.

Indonesian society is not well equipped with the understanding of Syari’ah Insurance. The problem exists due to the lack of socialization of its products. Few Ulemas or preachers speak about Syari’ah Economic during their sermon. It makes the urgency of Syari’ah Insurance less attractive. Let alone, Syari’ah Insurance has some protections, Usefulness and Islamic values.

According to Riza Maulana, Secretary Of Syari’ah Inspectorate Board of Takaful, The basic principles of Syari’ah Insurance Namely, first the order of Allah SWT to prepare the future. In the verse of An Nisa/04:09 illustrates that the importance of accurate planning for the future. As can be seen thru the life of the prophet Yusuf a.s. how he could build the protection’s system to face any possibilities which might happen in the near future (QS. Yusuf/12:43-49).

Second, Holding insurance policy does not mean to reject the destiny. Taking out the Insurance policy is not supposed to vanish the attitude of surrender to God, The Almighty. What happen in this world is all determined by Gog Willing. The Individual is only supposed to give effort maximally.  Cause will arise effect. To this point, something happen after an individual thinks well, works seriously, carefully and thorough.

In general, there pro and cons regarding Insurance in the eyes of Syari’ah. First opinion comments that the law of Insurance is “Halal” (acceptable). There is no argumentation of forbidden of Syari’ah insurance. The second opinion defends that Insurance is forbidden and not accepted. It contains “Gharar/uncertainty,” “Maisir/Losing another,” and “Riba/rate of interest or additional fees.” The Last opinion comments that Insurance is accepted, If It is implemented based on Islamic Rules and Values.

Practically, Insurance is divided into two namely, First, Syari’ah Insurance and second, conventional Insurance. What makes them different?  According to Ulemas or the priest, Conventional  Insurance has four forbidden points. First, it contains “gharar/Uncertainty” substance. Second, It contains the “Maisir/Losing another” substance. Third, it containes “Riba/Rate of interest”  Substance. And last it takes other’s wealth null and void.

Meanwhile, operationally, Syari’ah Insurance is implemented based on Islamic System or it adopts Islamic ways of managing the money. Based on the verdict of National Syari’ah Committee No. 2/DSN-MUI/X/2001, Syari’ah insurance is based on Koran (Q.s Al Maidah ;2). To add, Syari’ah insurance applies sharing risks among the participant or holders of Policy. It has Syari’ah Inspectorate Board. The profit is divided between customer and insurance company. Here, Syari’ah Insurance is in charge of holding the mandate. What make them different specifically is in terms of covenant of policy. Syari’ah insurance has the covenant of “Ta’awuni” or helping one another.

There are some considerations before deciding to choose the syari’ah insurance for your future protection. The basic simple one is you can see whether the insurance company has Syari’ah Inspectorate Board in terms of system or operational. It applies the covenant of “ta’awuni” (helping one another). You may ask some holders of policy how the process of claims. You may check to the board related overseeing the capital and modal. You may browse on the internet.
